We want to bring an important update to your attention regarding the Texas Supreme Court’s decision in Horton v. Kansas City Southern Railway Co., 692 S.W.3d 112 (Tex. 2024). This update is for Section 251.2 of the Texas Pattern Jury Charges — Family & Probate, 2024 ed.
The 2024 edition of Texas Pattern Jury Charges Family & Probate was published prior to the issuance of the opinion, but we are updating the hard copy edition and digital download with caveat language advising practitioners to stay informed regarding developments related to broad-form jury charge submission and the Casteel doctrine.
Because of the timing of the Horton decision, we have also decided not to incorporate it into the upcoming newest editions of the civil Texas Pattern Jury Charges. However, those editions also contain a similar caution.
Please Ensure Your Texas Pattern Jury Charges — Family & Probate, 2024 ed., is Updated
All hard copies and digital downloads of Texas Pattern Jury Charges — Family & Probate, 2024 ed., must be updated with the latest Horton caveat language to maintain accuracy and consistency. TO UPDATE YOUR PJC FAMILY & PROBATE DIGITAL DOWNLOAD:
- To install the updated digital download, log in to your account at texasbarpractice.com.
- Go to the Account Menu in the upper right-hand corner of the window.
- Click on “My Account,” and under “Downloadables,” navigate to Texas Pattern Jury Charges, Family and Probate, 2024 ed.
- Click the “Download” button and save this folder to your computer.
TO UPDATE YOUR PJC FAMILY & PROBATE HARD COPY:
- If you purchased a hard copy, you will have received three labels by mail. The two large labels should be placed over the current pages 382–383, which contain PJC 251.2 Broad-Form Issues and the Casteel Doctrine (Comment). Please replace the original pages with these updated versions.
- To affix the supplement to the pages of the book, simply remove the peel-off strip, place the supplement over the page, and press down firmly.
- Place the smaller label on the inside front cover.
